I was rear ended, and the person who hit me refuses to call their insurance company. What can I do?

-I was rear-ended by some stoned/drunk girl on the way home from the 4th of July fireworks. I have called my insurance company, which is also the girl's insurance company and they have deemed the vehicle totaled and also that we can get a loaner. However, to proceed, they need to talk to the girl who hit us who has still yet to answer their calls or call her insurance company.



Is there anything I can do? It's been 3 days already. Can the cops go down there and make her call?



Should I sue?if you have collision coverage your insurance company should be paying for for the damage or the replacement of your car. if you dont ya they do need to talk to her, i would call the cops and see what they say.

i once waited 3 months and i was not at fault, i called my insurance company i was very polite but told them i had talked to a lawyer 3 days later they called and had a CQ ready for me :)

if she was drunk, and the cops tested her and , if thats on file her insurance company can refuse to pay , so if there is no paper work of that i wouldnt bring it up,Did you get a police report/file number? I should think with that that your insurance company will honor your claim (eventually) and issue you a check for your loss, especially since you both have the same insurance company
You didn't call police at the accident scene?

Here's what's gonna happen. She will claim she was no where near you the night of the accident. And without any witnesses (which is why you call police) she'll probably get away with it.
Call and make a police report, and if they wont call, call their insurance company with their information and then go for the lawsuit.
you can call the cops i think but you can definatley sue but if you sue make sure you have evidence
