-POA = Power of Attorney. I only have Power of Attorney and no executor of the will. My aunt passed away and left my brother her car and we need to transfer the title over so he can use it, the problem here is that the old title is lost, how can we get a new title? We also have no written document that states she left it to him, it was verbal which i know does not help at all.The POA is worthless. It died with your aunt.
The ONLY way that you can get title is through the probate process. Her will, or her state's intestacy laws if she died without one, will determine who (if in fact anyone) gets the car. Her verbal statement prior to her death is worthless.
Once her estate goes into probate the executor can get a title and sign it over according to the will or state law, whichever applies in this case.
No will allows the State to step in and get some big bucks in taxes. Hire an attorney. Your POA died when your Aunt did. No one can get a Lost Title until the Estate is taken care of.
A power of attorney dies with the person who created it.
If a person dies without a will (the legal term is "intestacy") then their estate has to go through probate court.
