-Long story short, I was driving my uncles car (RI Plates) in CT on Route 2, when a green Jeep Cherokee V8 took over using the merge lane. I was following the Jeep on the single lane road for a mile or two when for no apparent reason, the guy slammed his breaks in front of me and stopped in the middle of the road. I tried doing the same but my cars tires locked and with no traction/steering control, I rear ended the jeep. Whats mind boggling is there was no traffic light, intersection, car or anything in front of him. Why would he just decide to come to a complete stop.
He pulled his Jeep off the road and walked toward me, I got out the car, he asked if anyone was hurt, I replied no. He told me instantly, "I gotta go, I got a flight to catch". WTF!? I was surprised, I asked him to exchange paperwork, he dint say much and just got into his car and left. I managed to get the first four number of his MA plate for sure but the last 2 are iffy.
I just dont understand him deciding to stop in the middle of road for no reason. Taking off, I'd imagine he had no insurance, license or registration. Fact remains, I rear ended the guy. So even if I hypothetical find the person, would it be his fault or his insurance would pay for my uncles car?You are 100% to blame for the accident itself, whether he was driving illegally or not is irrelevant. As a driver you have an obligation to keep a distance that will give you sufficient time to stop if the car in front of you stops quickly, you failed on that. Why he stopped doesn't really matter, if a kid ran out you still would have hit him.
So if your uncles car is damaged, his insurance will pay for it (assuming he has collision). You should pay the deductible since it was your fault. His insurance would also be paying for the other car too if the guy didn't take off, so you are lucky there.
live and learn!It is 100% your fault for not having assured cleared distance. You were following too close. Even if somebody slams on their brakes in the middle of the road, you're supposed to give yourself enough distance behind them to be able to stop in time. Sorry but you were tailgating or else you would have been able to stop.
He could face charges for leaving the sceen of an accident. But you are technicaly at fault. However it apears that he did this maliciously so you might be cleared. Start by reporting it to your insurance and the police.
Technically its a half half ... I understand ur car went into lock after he did that.... he must have been doing something in order to suddenly stop like that.... I don't wanna say its ur fault cuz he should have pulled over.... that's the natural thing to do.
I'm in jersey ..if u. Can't control ur vehical and u run in back of em ur at fault ..but I don't know for CT.. or RI rules um I think it a draw there and basically just to put it that was a hit and run incident .... if something is wrong he should pull over or put is four ways on to alert u ... so u wouldn't have got into the accident ya know... laws r weird but if I was a judge. For road driving id say ur not at fault ...but the state may say different outta law and regulations on CT driving laws ..hope this helped a lot .
